1. Agreement to Terms
By accessing or using PartyQuiz.me (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by the owner of PartyQuiz.me ("we," "us," or "our").
2. Description of Service
PartyQuiz.me is a web-based platform that allows users ("Hosts") to create interactive quizzes for events such as weddings, birthdays, team events, graduations, baby showers, and other celebrations. Guests ("Participants") can join quizzes via QR code, text link, or email invitation without downloading an app.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
4. User Accounts
4.1 Account Creation
To create quizzes as a Host, you must register an account by providing a valid email address and creating a password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.2 Guest Participation
Participants may join quizzes by providing a display name without creating an account. Display names must not be offensive, misleading, or impersonate another person.
5. Acceptable Use
You agree not to use the Service to:
- Upload, create, or distribute content that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable.
- Infringe on the intellectual property rights of any third party.
- Attempt to interfere with, compromise, or disrupt the Service or its underlying infrastructure.
- Use automated scripts, bots, or other tools to access or interact with the Service.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Collect personal information from other users without their consent.
We reserve the right to suspend or terminate your access to the Service at any time if we determine, in our sole discretion, that you have violated these Terms.
6. User Content
6.1 Ownership
You retain ownership of any quiz content, questions, and other materials you create through the Service ("User Content"). By creating User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your User Content solely for the purpose of operating and providing the Service.
6.2 Responsibility
You are solely responsible for your User Content. We do not endorse or guarantee the accuracy, completeness, or quality of any User Content. We reserve the right to remove User Content that violates these Terms without prior notice.
7. Intellectual Property
The Service, including its design, logos, text, graphics, and software, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless PartyQuiz.me, its operators, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
11. Third-Party Links
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party sites. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
12. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We may also update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service with a new effective date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
13. Termination
We may terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will cease immediately. Sections 6 through 10 shall survive termination.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PartyQuiz.me regarding the Service and supersede all prior agreements and understandings.
